Instant Record Terms of Use

These terms are between you and Smorgi Apps for Instant Record. Using the app means you agree. Studio-wide terms also live at smorgiapps.com/terms. Questions: support@smorgiapps.com.

License

Smorgi Apps grants you a personal, non-transferable license to use Instant Record on Apple devices you own or control, for your own personal-safety evidence locker. You may not resell, sublicense, or redistribute the app.

Recording-consent laws

You must follow local recording-consent laws. You are responsible for how you record other people, including whether notice or consent is required where you are. Instant Record does not give legal advice.

Not a substitute for 911 or professional security

Instant Record is software. It is not a substitute for calling 911, other emergency services, or professional security. We do not send 911 and we do not dispatch help.

Purchases

The app is free. Off-Device Protection is a $9.99 one-time In-App Purchase billed by Apple and subject to Apple’s terms. Refunds are handled by Apple through Report a Problem. We do not receive your payment card details.

Cloud files

If you unlock Off-Device Protection and connect iCloud Drive or Google Drive, finished clips and location files live in your Apple or Google accounts. Their terms apply. We do not host those files. Trusted Circle shares use your iCloud account.

Warranty disclaimer

Instant Record is provided “as is.” It is standard software, not a guarantee of safety. Recording can fail because of iOS limits, storage, heat, a locked device, a dead battery, or a lost network. Video cannot continue after you leave the app. A clip still being written may never reach the cloud.

Limitation of liability

To the extent the law allows, Smorgi Apps is not liable for indirect, incidental, special, or consequential damages, or for any loss of recordings, or for any harm that Instant Record did not prevent. Our total liability for Instant Record is limited to the amount you paid for Off-Device Protection, if any.

Governing law

These Instant Record terms are governed by the laws of [State/Country of Smorgi Apps], without regard to conflict-of-law rules, except where a consumer-protection law in your region requires otherwise. The studio terms on this site name California for Pinewood Creations LLC; this product page does not invent a different jurisdiction.
